Car Accident?

Make sure to follow this guide protect yourself.

  • Always file a police report after an accident.
    • In Florida, if your name was not listed in the police report, then there is a wide presumption that you were not involved in the motor vehicle accident.
  • See a doctor right away.
    • Seeing a doctor right away will help show the insurance that you experienced injuries from the accident and will have physical proof in the form medical records and a diagnosis from your doctor.
    • Make sure you tell your doctor ALL the areas you feel pain from the accident, and don't downplay your levels of pain.
  • Go to the doctor regularly after a car accident.
    • The insurance will assume that you are not hurt if you do not go to the doctor on a regular basis after an accident.
  • Follow the doctor's orders in a timely manner.
    • MRI scans are the gold standard of proving your injuries to insurance companies.
    • If a doctor recommends injections or surgery, the insurance companies are legally obligated to pay for those expenses AS LONG AS your car accident case is still pending. Once a case is settled, it can't be reopened.
  • Hire a lawyer early in your case.

What happens if you wait too long to see a doctor?

If you take too long to see a doctor after your car accident, the insurance company can claim that:

1. You weren't actually injured from the accident.

2. You got hurt from something else after the car accident, and you are dishonestly claiming the accident as the source of your pain and/or injuries.

In Florida, you must see a doctor (doctor of medicine, doctor of osteopathic medicine, dentist, doctor of chiropractic), visit a hospital, or receive treatment from a paramedic within 14-days if you wish to have access to $10,000 in personal injury protection (PIP) no-fault benefits from your insurance.

Often, the insurance company's adjuster will offer your money right way and try to get you to sign settlement paperwork before you can hire a lawyer -- Don't take it. Consult with a lawyer first, the consultation is typically free of cost.

Insurance companies are a business and are looking to make a profit, and they do this by taking insurance premiums from ccustomers and then paying as little as possible to settle claims. 

If you receive a call from an insurance company adjuster after an accident, then you can tell them that

1. You hired a lawyer and to direct all call to the respective lawyer

2. You will call the adjuster back when you have time

  • You do not want to say something, or forget to mention someting, that could minimize your chances of receiving fair compensation for your injuries.
