Worker's Compensation

What is worker's compensation?

Worker's compensation is one type of insurance which provides wage replacement and medical benefits to employees who have been injured during their course of employment in exchange of the employee's rights to sue his employer for the tort of neglience.

Workers' compensation is an important benefit that can be a lifeline for an injured employee. Chiropractors and Physical Therapists often have important roles to play in providing care under the program.

Filing Workers Compensation

How to file for workers compensation?

Step 1: Notify your employer when the injury has occurred. The law requires you to report the accident within 30 days or within 30 days of a doctor determining you are suffering from a work related injury.

Step 2: Seek medical treatment. Florida law requires injured workers to seek treatment from a doctor authorized by their employer's workers' compensation insurance carrier. Your employer should provide you with information about authorized medical providers.

Step 3: Complete DWC-1 Form, also known as the "First Report of Injury or Illness." This form should be completed to report the injury or illness to your employer's workers' compensation insurance carrier.

Step 4: Submit your claim. Complete the required forms accurately and submit them to your employer's workers' compensation insurance provider. Make sure to keep copies of all documents for your records.

Step 5: Receive benefits. If your claim is approved, you should start receiving workers' compensation benefits to cover medical expenses and lost wages. The amount and duration of benefits can vary based on factors such as the severity of your injury and your jurisdiction's laws.
